Information Text on the Protection of Personal Data

This text has been prepared by Okan Gönen (“WOOD MOOD WORKS”) in order to fulfill our obligation to inform, as required by Article 10 of the Personal Data Protection Law No. 6698 (“LPPD”).

WOOD MOOD WORKS reserves the right to update this text at any time in accordance with the current legislation.

1) What is the identity of the Data Controller?

The Data Controller is Okan Gönen (“WOOD MOOD WORKS”), operating at the address “İLİMTEPE MAH. 333. SK. TÜPRAŞ SİTESİ NO: 28 /124B, 41780 Kocaeli, Turkey” and registered with the Istanbul Trade Registry Office with registration number 582326.

2) What are the Methods of Collecting Personal Data?

Your personal data is collected and stored when you become a member of our website named www.woodmoodworks.com (“Site”) for shopping purposes or when you use the Site without becoming a member, when you fill out any form belonging to WOOD MOOD WORKS, when you purchase any product from WOOD MOOD WORKS, when you contact WOOD MOOD WORKS regarding our services.

3) What are the Purposes of Processing Personal Data and the Legal Reasons for Collecting It?

3.1. WOOD MOOD WORKS processes your personal data for the following purposes, based on the legal reason “Processing of personal data of the parties to a contract is necessary, provided that it is directly related to the establishment or execution of a contract”, as specified in subparagraph c of paragraph 2 of Article 5 of the KVKK:

  • To mediate your payment transactions and collect payments,
  • To ensure that the products you purchase are sent to you,
  • To invoice you and send the invoice,
  • To be able to carry out the relevant delivery and similar processes of shopping transactions,
  • To meet all kinds of needs within the scope of customer services, except marketing, to make expense and identity verifications and refunds, to resolve all kinds of disputes regarding shopping and website use,
  • To be able to determine the rights holders in case of a dispute regarding purchases.

3.2. WOOD MOOD WORKS processes your personal data for the following purposes based on the legal reasons stated in subparagraphs a and ç of paragraph 2 of Article 5 of the KVKK, “It is clearly stated in the laws (Law No. 5651 on the Regulation of Publications Made on the Internet and Combating Crimes Committed Through Such Publications, Law No. 6563 on the Regulation of Electronic Commerce, Law No. 6502 on the Protection of Consumers)” and “It is mandatory for the data controller to fulfill its legal obligations”:

  • To fulfill the requests from official institutions,
  • To be able to carry out transactions related to electronic commerce in accordance with the law,
  • To be able to carry out processes within the scope of consumer legislation in accordance with the current legislation.
  • Keeping logs, IP and traffic records to monitor the security of transactions on the Site

3.3. WOOD MOOD WORKS processes your personal data for the following purposes based on the legal reason “It is mandatory for the establishment, exercise or protection of a right” specified in subparagraph e of paragraph 2 of Article 5 of the KVKK:

  • In case of any dispute during the use of the site, to identify the relevant rights holders and to provide the means of proof.

3.4. WOOD MOOD WORKS processes your personal data for the following purposes based on the legal reason “Data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the relevant person” specified in subparagraph f of paragraph 2 of Article 5 of the KVKK:

  • To prevent, detect, minimize and investigate activities that constitute fraud or deception, constitute a security breach, or are suspicious or unlawful,
  • To be able to keep shopping records,
  • To be able to detect risky members operating on the site and to control the membership and products of sellers,
  • To resolve any disputes arising from the content on the Site.

3.5. WOOD MOOD WORKS may also use your personal data if you give your explicit consent. Within this framework, data processing activities can be carried out based on the following purposes:

  • To be able to shop on the Site,
  • To make an appointment with Wood Mood Works Plus,
  • To contact you by e-mail, telephone, SMS or post to offer coupons, discounts and special promotions, to learn your opinions through surveys or questionnaires by processing your contact information,
  • To provide you with targeted marketing and promotional offers based on your communication preferences,

In cases where you have given explicit consent, you can withdraw your explicit consent at any time. To do this, you can contact us by sending an e-mail to info@woodmoodworks.com.

4) To Whom and For What Purposes Can Personal Data Be Transferred?

WOOD MOOD WORKS transfers to third parties in accordance with Articles 8 and 9 of the KVKK. Within this scope, the processed Member Customer/Guest Customer data and the person information to whom the purchased product will be delivered are shared with the cargo/transportation company. The person information for whom the invoice will be issued is shared with the cargo/transportation company for the purpose of sending the invoice to the relevant person.

The mobile phone number and/or e-mail address of the Member Customer/Guest Customer is shared with the commercial electronic message service provider for the purpose of making promotions, advertising, offering benefits and opportunities in line with the shopping preferences, tastes and habits, based on the precondition that the relevant person gives explicit consent.

The data obtained during the registration/order/Wood Mood Works Plus appointment of the Member Customer/Guest Customer during the site membership registration process or during the order placed without becoming a member or during the Wood Mood Works Plus appointment are stored on the servers of Shopify located abroad from which we receive website hosting service. This transfer is only carried out with the precondition that you provide your explicit consent.

We may also share personal data with third parties and law firms involved in legal proceedings in response to a subpoena, court order or substantially similar order, or if we believe in good faith that it is necessary to prevent imminent physical harm or financial loss or to report suspected illegal activity.

We would also like to remind you that we are obliged to share your personal data with the appropriate competent authorities (such as courts, prosecutors' offices, enforcement offices) in accordance with the current legal regulations, particularly the Law No. 5651 on the Regulation of Publications Made on the Internet and Combating Crimes Committed Through Such Publications, the Law No. 6563 on the Regulation of Electronic Commerce, and the Regulation on Commercial Communications and Commercial Electronic Messages.

5) Your Rights Under the Personal Data Protection Law

In accordance with KVKK, your personal data;

  1. To find out whether it is processed or not,
  2. Requesting information if it has been processed,
  3. To learn the purpose of processing and whether it is used in accordance with its purpose,
  4. Knowing the third parties to whom the data is transferred domestically / abroad,
  5. Request correction if it is processed incompletely/incorrectly,
  6. Request deletion/destruction within the framework of the conditions set forth in Article 7 of the KVKK,
  7. Requesting notification of the transactions made pursuant to articles (e) and (f) above to third parties to whom the data was transferred,
  8. To object to a result that is to your detriment due to analysis by exclusively automated systems,
  9. If you suffer damage due to processing of your data in violation of the KVKK, you have the right to demand compensation for the damage.
